Terms and Conditions

Mandurah Car Hire Terms and Conditions

All Rentals incur a $500 deposit for the duration of the rental.

Payment in advance may be required from time to time.

Refunds for cancelled rentals will be done at the sole discretion of the owner.

All rates quoted are for 3 days and more and exclude GST. Rentals for fewer days will be charged as per calculated on website.

3 Tonne Trucks are on Special for $143 including GST per day Monday & Tuesday; $231 including GST per day, Wed – Sun.

Pre paid truck rental bookings may be refunded at the sole discretion of the owner, if more than 72 hours cancellation or reschedule notice is given.

If you cancel with less than 72 hours’ notice, the rental amount will be forfeited.

If you reschedule with less than 72 hours’ notice, a $100 penalty will be applied.

Please note that trucks are rented from 08:00 – 08:00.

If you wish to pick up later, please arrange with the office when making the booking.

If you don’t arrive to pick up the vehicle by 09:00, you have not made arrangements in this regard and we cannot contact you via the mobile phone number provided at the time of booking, we will put the truck back into the rental pool and you lose your pre-paid rental amount.

Note : All trucks to be returned at 08:00, irrespective of time of pickup, so as to give the following customer a full day’s rental.

Online Special:

The Online Special rates are only available for online bookings for 7 days and more. The type of vehicle may change on the day of pick up depending on availability. It will always be a 4 door vehicle, but may be hatch or sedan and the transmission may be manual or automatic. 200 Free Km’s per day : 30c /km thereafter.

Fare and Reward:

Please note our vehicles are not be used to carry fare paying passengers. This includes but is not limited to Uber Driving, Taxi driving, PTV driving etc. You may not transport fare paying passengers.

Insurance:

All our vehicles are insured, but they have a $4,000 excess.

Additional insurance will be offered at the time of rental.

If our vehicle has been damaged maliciously, on our sole opinion, you will be deemed to have breached the rental agreement and the damage waiver will be void.

Late Returns:

Vehicles returned late, without prior arrangement with our office, will be charged triple the daily rate for each late day, or part thereof PLUS a $100 penalty.

After Hours Returns:

After hours returns are NOT available unless arranged and noted on the signed agreement at the time of rental. Vehicles get vandalised when parked outside our gates and the renter will be held liable for any damage caused during his rental and the time before it is checked in by our staff. We are happy to arrange for after hours drop off at an agreed, specified time, at the time of rental – AND it has to be noted on the signed agreement.

Truck Returns:

Unless “After Hours Returns” have been arranged as required above, all trucks must be returned between 07:40 and 08:00 in the morning when the vehicle is due.

Damage:

Damage to our vehicles is marked on the diagram overleaf. Check this, AND the inside of the vehicle prior to leaving our yard. If you return a vehicle with damage not marked on the diagram at the time of rental, or missing headrests, ash trays, lighter sticks etc, you will be held liable for the repair costs, taking into consideration the excess reduction taken – read along with the paragraph “Insurance” above.

Fuel:

Vehicles are rented full. They need to be returned full. The gauge needs to show full upon return. If it does not show full, you will be given the opportunity to go and fill it, or the charges overleaf will be applied.
Trucks need to show full too – Diesel foams and the bowser may click off before the tank is indeed full. Please check the gauge before going to pay for the fuel to ensure the tank is full. We simply look at the gauge upon return.
If the vehicle is not full at the time of rental, please let the staff know and we will mark it as such on the contract before you leave our yard.

Some trucks have two fuel tanks and you need to refuel BOTH, as fuel from both tanks are being used simultaniously.

Non Communication:

The renter acknowledges that he/she is in possession of our asset. In this light we will need to communicate with the renter from time to time. The renter agrees to be available during business hours and after, on the telephone number provided upon entering into the agreement. If we fail to reach the renter on this number for any reason, or the renter fails to reply to messages within 2 hours, we will apply the $100 penalty for non communication. The same goes for email correspondence.

INTERPRETING YOUR RENTAL AGREEMENT

The Rental Agreement (“Rental Agreement) between Mandurah Car Hire and You is made the date shown on the rental Document You have signed in respect to the Vehicle (rental Document) and is made up of the Rental Document & these Terms & Conditions

Authorized Driver/ joint Renter” means:

An additional driver who is noted on the Rental Agreement as an Authorized Driver or joint renter

Rental Car Company Name, Mandurah Car Hire (MCHC) means National Cars PTY LTD ABN 84 610 460 298

Rental Period” means the period commencing on the date shown on the Rental Document & ending on the date that you return the vehicle to MCHC.

Substitute Vehicle Insurance” means the policy of motor vehicle insurance held by You or an Authorized Driver which covers You or the Authorized Driver while you or the Authorized Driver use the vehicle as a substitute for the vehicle insured under that policy

Vehicle” means the vehicle described on the Rental Document (or any substitute vehicle), and includes its parts, components, accessories and contents supplied by Mandurah Car Hire.

You or your” refers to the person(s) with whom the Rental Agreement is made.

Your Consumer Rights” means your rights as consumer under applicable consumer protection legislation, including the Trade Practices Act 1974 (Cth), which cannot be excluded, restricted or modified by this Rental Agreement.

DRIVER

  1. You agree and acknowledge that:
  2. a) Only you or an Authorized Driver will drive the vehicle. And
  3. b) You and any authorized driver are currently licensed to drive the vehicle and have been so licensed to drive for a period of 12 months or longer (excluding any time under a learners permit or a provisional license). And
  4. c) You and the authorized driver are not under 21 years of age. And
  5. d) You and the Authorized Driver have not had your license cancelled, endorsed or suspended within the last 3 years.

WHERE YOU CAN AND CANNOT DRIVE THE VEHICLE

2.1 You and any Authorized Driver must only use the Vehicle on a road, which is properly formed and constructed as a sealed, metaled or graded gravel road.
2.2 You and any Authorized Driver must not, unless authorized in writing by MCHC, drive or take the Vehicle:
  1. a) To Kangaroo Island, Fraser Island, Stradbroke Islands or Morton Island;
  2. b) In Queensland;

(1) Beyond Chillagoe in a westerly direction

(2) Beyond Norman ton in a southerly direction

(3) If the vehicle is a passenger vehicle or truck, beyond Cape Tribulation or Laura in a northerly direction;

(4) If the vehicle has 4WD, beyond Cook town or Laura in a northerly direction

  1. c) Above the snow line in Tasmania, New South Wales and Victoria (being Jindabyne in NSW and Bright in VIC) from the beginning of June until the end of September.
  2. e) On beaches or through streams, rivers, creeks, dams or floodwaters.

USE OF THE VEHICLE

3.1 You and any Authorized Driver must:
  1. a) Not allow the Vehicle to be used for any illegal purpose, race, and contest or performance test of any kind;
  2. b) Not allow the vehicle to be used to tow or push anything;
  3. c) Not carry more passengers than may be properly accommodated by the seat belt restraints provided in the vehicle, or carry a greater load than that for which it was built,
  4. d) Not be under the influence of alcohol, drugs or have a blood alcohol content that exceeds the legal limit in the State or Territory in which the Vehicle is driven;
  5. e) Not allow the vehicle to be used to carry passengers for payment or reward of any kind;
  6. f) Not use the vehicle when it is damaged or unsafe;
  7. g) not use the vehicle to transport goods, except in compliance with all necessary approvals, permits, licenses and government requirements( to be obtained at your cost) and in accordance with the vehicle manufactures and MCHC recommendations;
  8. h) Not use the vehicle for the conveyance or towing of any load which is incorrectly loaded or secured or is in excess of that for which the vehicle was constructed;
  9. i) not, without MCHC prior written consent, use the vehicle to carry any inflammable substance which has a flash point under 22.8C or any other explosive or corrosive substances; and
  10. j) Not use the vehicle in contravention of any law.

3.2 You must pay for any unauthorized repairs to the vehicle and for all parking and traffic infringements in respect of the vehicle during the rental period.

3.3 You and any Authorized Driver must not carry any animal or pet in the vehicle.

3.4 You and any unauthorized driver must not drive the vehicle if MCHC have so directed you and any Authorized Driver.

MAINTENANCE, SECURITY AND SAFETY

4.1 You and any Authorized Driver must;
  1. a) maintain all the vehicles engine oils and engine coolant levels to the manufacturers specifications, as set out in the vehicle operation manual located in the glove box;
  2. b) Keep the vehicle locked and under your or the Authorized drivers personal control at all times; and
  3. c) Comply with any applicable seat belt and child restraint laws.
4.2 You must not have repairs to the vehicle carried out unless MCHC authorizes you to do so. MCHC requires verification of the cost of repairs for audit and GST purposes. You should obtain an original tax invoice/receipt to assist MCHC. MCHC will reimburse you for any repairs to the vehicle authorized by it, provided that the cost of those repairs is verified. To the extent that MCHC cannot verify the cost of repairs, MCHC will not reimburse you.

LOSS DAMAGE WAIVER, DAMAGE AND LOSS OF PROPERTY

5.1 Subject to this clause 5, you are liable;

  1. a) For the loss of, and all damage to, the Vehicle; and
  2. b) For all damage to the property of any person;
  3. i) Which is caused and contributed to by you or an authorized driver; or
  4. ii) Which arises from the use of the Vehicle by you or and authorized driver.

This clause 5 does not apply to any damage or loss for which MCHC is liable to you under this Rental Agreement. Remember that references to the “Vehicle” include all of its parts, components, accessories and contents (see definition of “Vehicle” in clause 1)

5.2 Subject to clause 5.3 if;

  1. a) You accept the Loss Damage Waiver option on the rental document at the commencement of the rental period; and
  2. b) Where applicable, you pay the excess shown on the Rental Document for each separate event involving damage to or the loss of, the Vehicle or for each separate event involving damage to the property of any third party which is caused by the use of the Vehicle by You or an Authorized Driver. MCHC:
  3. c) Waives your liability under clause 5.1 for damage to the vehicle or loss of the Vehicle; and
  4. d) that you and any authorized driver are entitled to be indemnified under a policy of motor vehicle insurance provided by a registered insurer for Your and an authorized Drivers legal liability to a third party for damage to the property of that third party which is caused by the use of the Vehicle by You or an Authorized Driver.

5.3 You must always pay, and clause 5.2 does not cover

(a) The excess shown on the rental Document if there is damage to or loss of the Vehicle or if there is damage to the property of any third party.

(b) The cost of rectifying any tyre damage not attributable to normal wear and tear

(c) The cost of repairing any damage caused deliberately or recklessly by

(1) You

(2) Any passenger carried during the rental period

(3) Any other driver of the Vehicle

(d) the cost of repairing any damage to the Vehicle or to third party property caused by you using or permitting the vehicle to be used in any area prohibited by the rental agreement or (e) the cost of repairing overhead or roof damage caused by no limited to contract between the vehicle and objects overhanging or obstructing the path of the vehicle or

(f) The cost of repairing any water damage to the vehicle or any underbody damage and any resulting damage from that underbody damage to the vehicle

5.4 For the purposes of this clause 5 the amount you must pay for any damage or repair that may be reasonably determined by Mandurah Car Hire and includes

(a) The cost of repairs to the vehicle or the market value of the vehicle at the time of the loss or damage whichever is the lesser

(b) Appraisal fees

©towing storage and recovery costs

(D) A reasonable administrative fee reflecting the cost of making arrangements for repairs and towing and other administrative activities and

(e) A per day loss of use fee based on the estimated downtime of the vehicle. If the amount determined by Mandurah Car Hire and paid by you under this clause 5.4 exceeds the final cost of the damage or repairs, Mandurah Car Hire will refund the difference to you

Owner’s Liability

1. A standard damage waiver of $2000.00 applies to the hirer if any damage is caused to the vehicle during the agreed rental period

2. The standard damage waiver can be reduced to $500.00 by paying an additional $22.00 a day on top of the agreed daily/weekly rental price

3. An age damage waiver of $500.00 is payable in addition to the standard damage waiver if the driver is under the age of 25

4. all expenses incurred by Mandurah Car Hire in respect to collection of monies owed and or recovery of vehicles shall be the responsibility of the hirer This is not limited and will include such expenses as debt collection agency fees solicitors fees any out of pocket expenses dishonor fees and Mandurah Car Hire employee time. These costs can and will be recovered by court action if required

RULES FOR HIRING VEHICLES FROM MANDURAH CAR HIRE

  • ALL VEHICLES ARE SUBJECT TO $4,000 EXCESS. THIS CAN BE REDUCED TO $500 FOR $44 PER DAY. (ONLY DRIVERS OVER 25 YEARS OLD QUALIFY)
  • VEHICLES ARE FULL WHEN HIRED AND MUST BE RETURNED FULL OR A CHARGE OF $220 WILL BE APPLIED. (TRUCKS AND BUSES $440)
  • 200 KMS FREE PER DAY WITH EXCESS KMS CHARGED AT 33c PER KM (100 KMs for online specials)
  • CUSTOMER IS LIABLE FOR ANY DAMAGE TO TYRES AND WINDSCREEN – IRRESPECTIVE OF INSURANCE TAKEN
  • NO PETS & NO SMOKING ARE ALLOWED IN ANY VEHICLE. A CLEANING CHARGE OF $100 WILL BE APPLIED IF ANY EVIDENCE OF PETS OR SMOKE ARE FOUND INSIDE
  • VEHICLES TO BE RETURNED IN A CLEAN AND TIDY CONDITION OR A CLEANING CHARGE OF $150 WILL APPLY: If Beach Sand is found in the vehicle, this charge will be applied.
  • UPON CHECKOUT IT IS THE CUSTOMER’S RESPONSIBILITY TO CHECK THE VEHICLE FOR DAMAGE WITH A REPRESENTATIVE OF MANDURAH CAR HIRE
  • IF THE VEHICLE IS TO BE RETURNED LATE, CUSTOMER MUST PHONE US OR AN EXTRA DAY’S HIRE WILL BE CHARGED
  • ONLY PERSONS WHO’S LICENCE HAVE BEEN SIGHTED ARE ALLOWED TO DRIVE THE VEHICLE
  • AN ADMINISTRATION CHARGE OF $50 WILL BE APPLIED FOR HANDLING OF TRAFFIC INFRINGEMENTS RECEIVED RELATING TO YOUR HIRE

CASH / EFTPOS RENTALS

  • $1,000 DEPOSIT
  • PROOF OF EMPLOYMENT: PAYSLIP WITH ADDRESS, NUMBER AND NAME OF EMPLOYER
  • PROOF OF ADDRESS: CURRENT UTILITY BILL
  • CURRENT DRIVERS LICENCE
  • SECOND PROOF OF ID: MEDICARE CARD, PENSIONERS CARD ETC
  • VEHICLE WILL BE REPORTED AS STOLEN IF MORE THAN 24 HOURS OVER DUE
